By making a booking, the first named person on the booking (“the party leader”), agrees on behalf of all persons detailed on the booking that:
1. He/she has read these booking conditions and has the authority to and does agree to be bound by them;
3. He/she is over 18 years of age.
We reserve the right to refuse any booking that does not comply with the supplier’s terms and conditions, including but not limited to: groups in which all guests are under the age of 25; stag parties or hen parties; or single sex groups, where applicable.
1. FINANCIAL SECURITY
In accordance with the provisions of The Package Travel, Package Holidays and Package Tours Regulations 1992, all deposit and balance payments for package holidays are held in a separate trust account until the package holiday is completed. In the unlikely event of our insolvency before a package holiday the monies paid are secure and will be refunded. If insolvency occurs during a package holiday and as a consequence additional costs are incurred, including repatriation, these will be refunded out of the monies held in the trust account.
We endeavour to ensure that all of the information and prices on our website are accurate; however, occasionally changes and errors occur and we reserve the right to correct prices and other details at any time. As prices can change you must check the current price and all other details relating to the arrangements that you wish to book before your booking is confirmed.
The prices of unsold arrangements may be increased or decreased and corrections made to errors in advertised prices at any time before your arrangements are confirmed by us or the supplier. The price of your chosen arrangements will be confirmed at the time of booking. We reserve the right to pass on to you in full, after your booking has been confirmed, all costs and/or charges incurred or imposed by any Campsite and/or Service Provider connected with your arrangements, including any price increases due to currency fluctuations. By accepting these terms and conditions you expressly agree to pay these additional charges. Where you pay only a deposit at the time of booking, full payment is due no later than 10 weeks prior to departure. We occasionally offer special offers and discounts but these will not be applied retrospectively after a booking confirmation has been issued by us.
4. BOOKING YOUR HOLIDAY AND PAYMENTS
Whether you book online, by phone or by e-mail, you will receive an e-mail confirmation for your booking. In this confirmation you will receive instructions on the required deposit and the time limit for the deposit to be paid. Payments must be in GBP Sterling and can be made by bank transfer, debit or credit card within the time specified on your confirmation. If payments are not received within the specified time then the holiday will be cancelled. There is no bank charges if you pay by bank transfer or debit card. There is a 2% charge on all credit card payments. The deposit is 20% of the holiday cost to secure accommodation + any deposit required by the transport provider. As soon as the deposit is received by France Break a contract will exist between you and France Break. The balance of the holiday cost should be received in full no later than 10 weeks before you are due to travel. Bookings made less than 10 weeks before departure must be paid for in full at the time of booking. If the total balance is not received, France Break will advise the supplier who may cancel the holiday and any charges incurred will be payable by you.
As accommodation starts to fill up it may not be possible to get an immediate confirmation for your booking request. In this situation you will receive a message that your booking is on request. Please note that if the accommodation requested is available this will immediately become a confirmed booking.
5. BOOKINGS ON REQUEST
When you book a holiday on request we contact the supplier on your behalf to enquire if they still have the required accommodation available. It can take up to 3 days for us to get a reply. We will then send you one of the following replies:
(i) The request is available: Your request will instantly become a confirmed booking. An invoice will be dispatched via email within 24 hours. Please note: Should you then wish to cancel, cancellation fees will apply; or
(ii) The request is not available: Should the supplier not be able to accommodate you, we will contact you by phone or email in order to try and find a suitable alternative holiday. You should not make any travel arrangements prior to receiving a written confirmation that your booking request has been accepted by the campsite.
If you wish to cancel your booking for any reason you must notify France Break as soon as possible. A cancellation charge will be payable, levied by suppliers. Where shown as a percentage, cancellation charges are calculated on the basis of the total cost payable by or on behalf of the person(s). On the date that the cancellation is received the cancellation charges below apply, expressed as a percentage of the total holiday cost. All days stated represent the number of days between your arrival day at the campsite and the date that the cancellation was notified to France Break in writing.
Number of days prior to the start of your holiday when written notification is received by us
and amount of cancellation charge:
• More than 70 days – Loss of deposit
• 70 – 35 days – 25% of holiday cost
• 34 – 15 days – 50% of holiday cost
• 14 – 8 days – 90% of holiday cost
• 7 days or less – 100% of holiday cost
In case of cancellation, it is not possible to transfer any money already paid, to the following calendar year. We strongly recommend that you take out travel insurance as part of your travel arrangement.
7. CHANGES MADE BY YOU
If you wish to change any part of your booking arrangements after our confirmation invoice has been issued, you must inform us in writing as soon as possible. We will endeavour to accommodate the request but cannot guarantee we will be able to make the amendment. Our amendment fee is £20 on all changes notified to us. You will also be charged for any amendment fees and/or increased costs levied by suppliers on services booked on your behalf.
France Break holds a contract with each campsite. Once your booking has been confirmed it is not possible to change your booking to another campsite without first cancelling your original booking. In this case your cancellation fee is outlined above and this payment cannot be transferred to a new supplier. If possible we may be able to make changes to your booking with your original supplier and in this case, you will also be charged for any increased costs arising from the changes that you make to your accommodation booking plus the amendment fee.
If we cannot make your requested change and you do not wish to continue with your holiday then your booking will be deemed as cancelled with effect from the date that the change was requested and the normal cancellation charge will apply. We reserve the right to refuse any changes to your booking.
Subject to availability, your holiday dates can be extended during your stay at the campsite. Extra nights should be requested and paid at the campsite main reception.
If you arrive late or leave early from your holiday no refund of money paid will be made. Furthermore, it is not possible, in any circumstances to transfer such paid amounts to a booking for the following calendar year.
8. CHANGES MADE BY US
In the unlikely event of unforeseen circumstances causing France Break or a supplier to alter your holiday details, we will inform you as soon as possible. If this results in a major change to your holiday (i.e. change of campsite, accommodation or dates) we will offer you a suitable alternative if available or, if this is not acceptable, offer you a full refund. In this case France Break will only refund accommodation costs or travel services that are booked and paid for by France Break.
Very rarely, we may be forced by “force majeure” to change or terminate your arrangements after departure (see clause 15, Force Majeure below). If this situation does occur, we regret we will be unable to make any refunds (unless we obtain any from our suppliers), pay you compensation or meet any costs or expenses you incur as a result.
9. SPECIAL REQUESTS
If you have any special requests (for example mobile home location or late arrival), please let us know at the time of booking. We will pass on all such requests to the campsite but we do not guarantee that they will be met and we will have no liability to you if they are not.
10. CAMPSITE RATINGS AND SAFETY STANDARDS
Accommodation ratings are displayed as provided by the French tourist board. These are intended to give a guide to the services and facilities you should expect from your campsite. We cannot guarantee the accuracy of any ratings given and no warranty is given or implied.
Safety standards in France may differ from those applicable in the UK. We strongly advise that all customers seek to minimise their exposure to injury by familiarising themselves with relevant safety information. If you fail to arrive on the day specified on your booking confirmation, you should inform the campsite reception as soon as possible (telephone number displayed on the travel voucher). If you fail to do so they may reserve the right to treat the booking as cancelled.
Please be aware that the booking conditions of our campsite suppliers and transport partners are such that your holiday arrangements can be terminated, with no refund, if the behaviour of your party falls below an acceptable standard. If this occurs overseas then you will become responsible for your own return home. Suppliers will also often require you to pay for any damage you cause to the accommodation or facilities on site. We are under no obligation to you if any event such as this occurs. You agree to indemnify us for the full amount of any claim (including all legal costs) made against us by the supplier as a result of your conduct.
12. DELIVERY OF DOCUMENTS
All documents (e.g. invoices, travel vouchers, tickets) will be sent to you by email. If tickets or other documents need to be reissued all cost incurred must be paid by you.
13. FINAL TRAVEL ARRANGEMENTS
Please ensure that all your passport, visa, travel and insurance documents are in order and that you arrive in plenty of time for checking in at the ferry port or train station. We accept no liability if you fail to check-in on time for any reason outside our responsibility.
14. PASSPORTS AND VISAS
Your specific passport, visa and other immigration requirements, are your responsibility and you should confirm these with the relevant Embassies and/or Consulates prior to travel. Neither we nor the suppliers accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements.
The contract for your arrangements is between you and the suppliers and any queries or concerns should be addressed to them. If you have a problem whilst on holiday, this must be reported to the supplier immediately. If you fail to follow this procedure, there will be less opportunity to investigate and rectify your complaint.
If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to us giving your booking reference and all other relevant information.
16. FORCE MAJEUR
Except where otherwise expressly stated in these booking conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by any event which the supplier of the service in question could not, even with all due care, foresee or avoid. Such events may include, but are not limited to war, threat of war, civil strife, terrorist activity and its consequences or the threat of such activity, riot, strikes, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, adverse weather conditions, fire, chemical or biological disaster and all similar events outside our control or the control of the supplier concerned. We will however, give prompt assistance to any customer in difficulty.
17. ACCOMMODATION PROPERTY OF THE CAMPSITE
The accommodations on this website are the property of campsites. The responsibility for management and maintenance of these accommodations is therefore with these campsites.
The floor plan, pictures and description given on this website are for guidance only. Size, layout and décor will differ between campsites, although specifications and quality level will not.
18. ARRIVAL AND DEPARTURE
Your accommodation will be ready for you at the time stated on your travel documents. On arrival, you will be required to pay a security and cleaning deposit, which will be returned, provided no loss and/or damage to the accommodation and/or equipment was found at the end of your stay and that the whole accommodation was left clean.
On your day of departure, checkout is in the morning at the time stated on your travel documents. If you arrive later or depart earlier than your reserved dates, there will be no refund for the unused part of your booking and this will also entitle the supplier to resell the accommodation. Reserved extras are per booked campsite to include the same period as that of the booked accommodation.
19. ACCOMMODATION ALLOCATED
When making your booking, you agree to accept the accommodation allocated to you by the campsite, regardless of any special requests that you made at the time of booking. If you are not happy with the cleanliness or condition of the accommodation you should report this to main reception immediately.
It is your responsibility to look after the accommodation and equipment during your holiday. You will be liable for any loss and/or damage to the accommodation and/or equipment, regardless if it was due to lack of due care and attention, or a third party.
There may be subtle differences in the appearance and layout of the accommodations. Pitches may vary in size and shape, even on the same campsite.
Campsites reserve the right to claim for damages and/or loss to accommodation and/or equipment during your stay. If damage and/or loss is detected you should report this to main reception as soon as possible. This will ensure the issue and any associated problems can be resolved on site.
The holidays in this programme are based on a single family with one car. Any variation in this may cause problems at some campsites and this will be at your own risk and cost. It is not always possible to park near to your accommodation and you may have to park in the campsite car park. On some campsites motorcycles are not allowed.
As we are acting as agent, we do not accept liability for the acts or omissions of the suppliers/owners of the campsites. The majority of campsites offer a personal safe hire service at the main reception or within the accommodation. France Break guests must respect the Campsite regulations and rules. Should these be ignored, France Break and the campsite reserve the right to deny further access to the accommodation and/or the campsite. In these circumstances France Break will give no refunds. Most campsites ask for night time silence normally between 23:00-08:00. During this period there is no vehicle access into or out of the campsite. Some campsites issue barrier cards for vehicle access and/or security wristbands. You may be charged a deposit for barrier cards and /or security wristbands, which you may not get back if you lose them.
Pets are allowed at certain campsites only (see campsite pages for details). Campsites and cross Channel operators may charge an additional fee. Restrictions may be imposed on your pet. You must notify us at the time of booking if you are taking a pet.
22. BOOKABLE EXTRAS AND SUPPLEMENTS
We offer a range of bookable extras to help make your holiday as enjoyable as possible. To guarantee availability, you need to add any extra to your booking up to 4 weeks prior to your date of departure. Should a pre-booked extra not be delivered by the campsite, we’ll refund you the amount of the extra not delivered in full.
23. OUR LIABILITY TO YOU
Every effort has been made to ensure that the information displayed on this website was correct at the time of publication on 30 September 2016. We do not accept any liability for any errors, omissions or changes made during the holiday season. Nor do we accept liability for any events beyond our control, such as adverse weather, noise pollution, building activities on site, vermin, work on or to the campsite facilities (e.g. swimming pool and Wifi) and other circumstances where the responsibility lies with the campsite owner. We do not accept any liability where any damage, loss of enjoyment or expense caused to you is from circumstances of ‘force majeure’, your actions or any third party not under the control of France Break. However, nothing in these terms and conditions seeks to limit or to exclude our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation, or for any statutory rights you have as a consumer.
24. DATA PROTECTION
During the booking process, we will obtain personal data from you, such as your name and address and the names and addresses or the members of your party. We confirm that we will comply with the Data Protection Act 1998. We may use certain data to inform you of future offers. If you do not wish to receive information then please contact us. You are entitled to a copy of your personal data held by us on payment of a small fee. Please write to us at the above address if you wish to make a data protection request.
To monitor customer service and for training purposes, we may record telephone calls.
25. LAW AND JURISDICTION
Any dispute arising under these terms and conditions will be subject to English Law and the Courts of England and Wales shall have exclusive jurisdiction.
